6. Authorization to Operate & Test Vessel

By authorizing service, the customer grants St. Brendan's Marine permission to operate, start, idle, rev, transport, trailer, or water-test the vessel as necessary to diagnose or complete services.

7. Payment Terms

• Payment is due upon completion of services, unless otherwise agreed in writing

• Accepted payment methods may include cash, card, or other approved methods

• Returned checks may result in additional fees

• Payments Past Due are subject to a minimum 10% interest fee by month.

• Storage fees may apply to unpaid or unclaimed vessels

Failure to pay may result in legal collection actions.

8. Mechanic’s Lien (Missouri Law)

In accordance with Missouri law, St. Brendan's Marine reserves the right to assert a mechanic’s lien on any vessel, trailer, or equipment serviced for unpaid labor, parts, storage, or fees.

Unpaid property may be:

• Retained

• Stored at the owner’s expense

9. Abandoned Property

Any vessel, trailer, or equipment left unpaid or unclaimed for 30 days or more may be considered abandoned. Storage fees may apply. Abandoned property may be disposed of or sold in accordance with Missouri law.

1. Acknowledgment of Risk

I understand and acknowledge that marine mechanical services involve inherent risks, including but not limited to mechanical failure, electrical issues, fuel system complications, corrosion, water intrusion, and component failure that may occur during or after service.

I acknowledge that marine vessels—especially boats and personal watercraft—often contain hidden defects, wear, or prior damage that may not be discoverable during inspection or repair.

2. Assumption of Risk

By requesting or authorizing services from St. Brendan’s Marine, I voluntarily assume all risks associated with marine repair, maintenance, diagnostics, winterization, testing, transportation, and operation of my vessel.

This assumption of risk applies to:

• Engines and propulsion systems

• Fuel, electrical, and cooling systems

• Water testing and test operation

• Winterization and freeze-related damage

3. Waiver and Release of Liability

• Additional labor caused by defective or incorrect parts is my responsibility

6. Authorization to Operate & Test Vessel

I grant St. Brendan’s Marine permission to start, operate, idle, rev, transport, trailer, and water-test my vessel as necessary to diagnose, test, or complete repairs.

7. Indemnification

I agree to indemnify and hold harmless St. Brendan’s Marine from any claims, damages, losses, or expenses (including attorney’s fees) arising from:

• My vessel’s condition

• My use or operation of the vessel

8. Electronic Acceptance

I understand and agree that:

• This waiver is accepted electronically

• Checking the acceptance box constitutes full legal acceptance

• No physical signature is required

1. Authorization of Services

By requesting service and/or submitting a work order, I authorize St. Brendan’s Marine to inspect, diagnose, repair, maintain, test, and perform related services on my vessel, trailer, and associated equipment.

This authorization includes permission to perform services necessary to identify issues, even if repairs are later declined.

2. Diagnostic & Inspection Fees

I acknowledge and agree that:

• Diagnostic and inspection services are billable

• Diagnostic fees apply whether or not repairs are approved

• Time spent troubleshooting, testing, or disassembly is considered labor

3. Estimates & Additional Repairs

I understand that:

• Any estimate provided is not a guaranteed final price

• Marine repairs may reveal additional issues once work begins

• Additional labor or parts may be required

• Approval may be required for significant increases when reasonably possible

I authorize St. Brendan’s Marine to proceed with necessary repairs within reasonable scope to complete the requested service.

4. Parts & Materials

I authorize the use of:

• New, rebuilt, or equivalent replacement parts when appropriate

6. Payment Responsibility

I agree that:

• Payment is due upon completion of services, unless otherwise agreed in writing

• Failure to pay may result in storage fees

• Unpaid balances may result in collection actions

7. Mechanic’s Lien Notice

I acknowledge that St. Brendan’s Marine reserves the right to assert a mechanic’s lien under Missouri law on any vessel, trailer, or equipment serviced for unpaid labor, parts, storage, or fees.

8. Abandoned Property

I understand that any vessel, trailer, or equipment left unpaid or unclaimed for 30 days or more may be considered abandoned and subject to storage, lien enforcement, sale, or disposal as permitted by Missouri law.

9. No Guarantee of Outcome

I acknowledge that marine repairs:

• Address specific reported issues

• Do not guarantee overall vessel reliability

• Do not prevent future failures

No promise or warranty of continued operation is made unless expressly stated in writing.
